This document outlines the Terms of Use ("Terms") and Privacy Policy ("Policy") governing your access to and use of kaama.net (the "Software"), a software-as-a-service product provided by Pankaj Taneja ("we," "us," or "our"), a sole proprietorship operating from Sector 18, Chandigarh, India with GST Registration Number 04AFKPT2940P1ZW. By accessing or using the Software, you ("you" or "your") agree to be bound by these Terms and Policy. If you are using the Software on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms and Policy.

1. Services

We provide you with access to the Software, which is designed as simple online video creation and editing tool. The specific features and functionalities are described on our website (https://kaama.net) and may be updated.

2. Account Registration

To upgrade, you must create an account. Provide accurate information and keep it up-to-date. You are responsible for your account credentials and all activities under your account. Notify us immediately of any unauthorized access.

3. Fees and Payment

You agree to pay the applicable fees, exclusive of GST, as detailed on our website https://kaama.net. Payments are due according to the published billing cycle.

4. Subscription and Cancellation

You are making nominal one time payments for a year in advance before using the service. This is non refundable.

5. Data Ownership, Export, and Retention

You own all data you input. We will retain your data as long as your account is active and for a month thereafter for backup purposes. After account deletion or termination, we may delete your data, subject to any legal obligations to retain it.

6. Software Sunset

We will provide at least two (2) months' notice of a Sunset Event. During this period, you can export your data. After the Sunset Event, access will be terminated.

7. Acceptable Use

You agree not to use the Software for any illegal or unauthorized purpose, including but not limited to:

• Impersonation
• Interference with the Software
• Targeting or offending protected groups
• Unauthorized access
• Automated access attempts
• Violation of laws

8. Intellectual Property

We retain all rights, title, and interest in the Software. You are granted a non-exclusive, non-transferable, revocable license to use the Software for your internal business purposes.

9. Disclaimer of Warranties

The Software is provided "AS IS" and "AS AVAILABLE" without any warranties. We do not warrant uninterrupted or error-free operation.

10. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability will not exceed the amount you paid us during the twelve (12) months preceding the claim.

11. Governing Law and Dispute Resolution

These Terms and Policy are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts in Chandigarh, India.
